Holding liable controlling persons in bankruptcy
Key cases
-
Representation in courts at all stages of bankruptcy in corporate conflicts arising from a change of ownership and management of organisations/businesses.
-
Participation in cases that influenced court practice in implementing mechanisms for holding a debtor's controlling persons liable (including shadow directors who have no formal legal signs of affiliation, but who actually manage the debtor's business). This included participation in legal entity bankruptcy cases where, for the first time in judicial practice, an individual was held subsidiary liable for bankruptcy debts (in an amount of over RUB 6 billion), who determined the business activities of the bankrupts without formally being a party to them.
-
Protection of creditors' rights as a result of management's misbehavior causing losses to the debtor. Representing the Client in bankruptcy cases of legal entities, in which a set of entangled related transactions involving withdrawal of the bankrupt's assets worth about RUB 2 billion were discovered and successfully challenged.
-
Representation of top managers of a bankruptcy-preventing lender in a case regarding recovery of losses under Article 189.23(5) of the Law on Insolvency (bankruptcy).
