Representation of the Client at the enforcement stage of proceedings. To protect the rights of the Client, a court dispute was initiated to appeal against a refusal to initiate enforcement proceedings caused by the formal expiry of the three-year deadline for filing an enforcement document.
According to the legal position the refusal was based on misunderstanding of the rules of law since the writ of execution had been issued based on a judicial act establishing the debtor's obligation to pay the periodic payments under the settlement agreement. The three-year period for filing an enforcement order should not have begun when it had been issued but when the deadline set for the debtor's compliance with the requirements contained in it had expired.
In the current atypical circumstances of the case the correct application of Article 21 of the Federal Law "On enforcement proceedings" was of key importance for the protection of the Client's interests. Based on these provisions of the law, payments of the debt within the time frame set forth in the enforcement order were recognized as periodic payments; therefore, the judgment in this case has a precedent character.
The outcome of the court proceedings was that the Client's claims were satisfied in full. -
Representation of the Client in a major family dispute over division of property located abroad. Evidence was gathered both in the Russian Federation and in foreign jurisdictions (US, UAE). The dispute ended with an amicable agreement on the Client's terms. As a result of the successful conclusion of the dispute, the Client obtained property of over 500 million roubles.
