Key cases

• Representation of a major contracting company in a court dispute with federal state unitary enterprise Dalspetsstroy, regarding a claim by the Dalspetsstroy against the Client for recovery of unjust enrichment and a penalty of 2 billion roubles, calculated under three construction contracts. The contracts were entered into for the purpose of carrying out the world's largest construction project: the Vostochny spaceport.
  In the course of the dispute, it was proved by the legal counsel that it was not the Principal who was responsible for the breach of contracts, but the Federal State Unitary Enterprise. As a result, the court dismissed the claims against the Client completely.
• Representation of a telecom operator in the Supreme Court of the Russian Federation in disputes with the Russian Government over regulatory legal acts of the Russian Government regulating the right to use the radio-frequency spectrum. The purpose of these disputes was to protect an investment of over 250 billion roubles which was used to apply innovative solutions in the field of commercial communications in Russia.
  A specific feature of the project was that at the time of legal assistance the topic of spectrum usage rights had not been studied either by courts or scientific community.
  The legal advice resulted in positive legal positions for the Principal at the level of the Supreme Court of the Russian Federation, which promoted his business interests.
• Representation of a leading steel company as a creditor in bankruptcy proceedings of an individual. The Client's claims against the debtor amounted to 2.5 billion roubles.
  In the course of legal assistance, it was possible to obtain invalidation of the debtor's transaction for withdrawal of its valuable asset (a share in the company's authorised capital). The case was complicated by the fact that the disputed transaction was covered up by a chain of multiple transactions consummated by the debtor and a large group of connected persons. In addition, as a result of the case, there were no unfriendly creditors whose claims, worth more than 500 million roubles, were confirmed by court rulings in non-bankruptcy cases (in fact, the courts implemented a new approach developed by the advocate).
  The legal assistance resulted in partial restoration of the Client's property status and formation of new practice in litigation.
• Representation of the Client in a dispute over division of property with her former spouse, who at various times was a founder and CEO of major Russian and international companies in the finance, construction, high-tech, mobile communications, and film industries. In the course of the matter, the ex-spouse repeatedly tried to put emotional pressure on the Client in order to prevent her from resolving the dispute, including by expressing an intention to deprive the Client of her parental rights.
  The legal assistance resulted in an amicable agreement on terms satisfactory to all parties to the conflict. The Client received the amount of property that she had hoped at the initiation stage of the dispute.
